There are ways to deal with that, and one of them is to keep the ownership of the instruments with the band boosters and loan them to the schools with the proviso that any budget cuts will result in the instruments being taken back. Or raise funds and offer them as a match on the funding provided by the schools. Or loan them to the schools without telling the school board at all (I can't think of any reason they would be obligated to do so).

The problem with taking the school board on is that they must fulfill mandated obligations while the money you raise can been spent on just what you need. Music is always optional in any school system, though not all are squeezed to the point where that option has to be exercised.

The problem with the story you mention is that the boosters bought something that wasn't really needed, and this can be interpreted as conspicuous consumption by politicians. I don't think buy a few critically needed musical instruments falls into the same category.
