I heartly agree with your first paragraph. However, what the school board did was punish the student for activities that they had no right to act on. The band director should have asked the parents to take the site down and if they did not, then he should sue for libel. He had every right to sue for libel right off the bat. The school board should not have gotten involved in something that did not occur in the school.
And the union may have well defended the teacher if he was taken to court. But it was the district that is paying the fine, not the teacher.
