An orchestra can choose whomever they want to fill a position. However, there's no reason they can't be honest about the process. If what you say is true then I'd guess they wanted the appearance of an audition so we'd think they were making an honest choice.
If they wanted a specific player then why not just offer him/her the job? Treating their candidates as they have displays an arrogance that is most distressing.
