I agree with what you wrote. I was just stating my opinions, not the legal view of the matter, which is why I worded it "should still be considered wrong" instead of "is illegal", or something to that effect.

If they were trying to claim a new lease on the copyright of the actual piece(can publishers do that?), then I'd view them in the same light I view the people who photocopy their music for 5 years of college... if they're claiming a lease on the copyright of their own publication, I don't really see any ethical dillema in that.
