Simple Answer: Yes. Just don't call it "TubaChristmas" unless you affiliate with the Harvey Phillips foundation, because he owns that trademark. And don't run the TubaChristmas books through the copy machine, because the music is protected by copyrights.
The trademark on the name, and the copyright on the Wilder arrangements, does not, however, apply to the idea of playing Christmas tunes with massed tuba ensembles.
