Trademark infringement, like patent infringement (and unlike copyright infringement) is a civil matter. That is, if you feel you're wronged, you hire a cage of weasels and sue the pants off the infringer. If you can't afford the weasels, you're out of luck.
So if Tony wants to preserve his stacke in TubaFest®, he'll have to pay some weasels to chase infringers. If you're a weasel yourself or own your own weasels, you may be able to turn the whole thing into a slugfest of who's got the deepest pockets or the most patience.
