It's just a matter of who rates the playing of Taps. Military-wise, there are certainly different levels of funeral ceremonies. For example, my grandfather, who started as a bomber pilot in WWII and retired in the late 70's as a Colonel and vice base commander, was honored with a ceremony which included a bugler, firing party, band, a flight of AF personnel, body bearers, and a horse-drawn caisson. That's already a lot, but there was no flyover -- that's reserved for Generals.

It has nothing to do with copyright issues -- those really only come into play when money and recordings are involved.
