That is a slightly different story.
Easiest way to solve things is to force the fund to dissolve and have another benefactor originate and begin another "fund" or charity organitzation. If you can do this legally, with a new charter and set of by-laws to prevent these problems, you might be in good shape 5 years from now.
Tough financial times make it apparent all the things that were wrong during the good times.
