Of course it's ethical to contact the seller after the auction if it doesn't sell. Ebay doesn't like it because they don't get their piece of the sale price, but it is merely a private sale between individuals. Of course you don't get ebay's insurance, but that's not very useful anyway.

I have also had people contact me after auctions to sell me things similar to things I have bid on, even if I wasn't the winning bidder. This is a more questionable practice. Even so, I bought my Distin BBb from someone who noticed that I had bought a Distin Eb on eBay and wanted to get rid of his BBb. I paid $175 for it, although it is just barely playable. Even though it needs a lot of work, I have still not found another Distin BBb, although I continue to look.
