it's sort of like when an artist releases 300 numbered prints of a popular painting.
Later, someone else scans one of the original numbered prints and sells (or even gives) copies to others, either with or without numbers.
Just because the material isn't available doesn't mean that one has the right to reproduce it, as official reproductions were authorized and continue to be of some particular value.
