Actually, that bogus track is the LAST track. CDs start from the inside and track outwards. That provides a consistent starting point for the laser.
It still works because CD drives skim over the whole disc, getting as much information as possible, including the bogus track. Mask the track somehow, and as far as the CD drive goes, it doesn't exist.
